OFFICIAL RULES
1. NO PURCHASE NECESSARY TO ENTER OR WIN.
2. HOW TO ENTER: Beginning on October 1, 2023 at 12:00 am EST through September 30, 2024 at 11:59 pm EST (“Sweepstakes Period”), eligible individuals may enter the Sweepstakes by one of the following methods of entry. Entries received or postmarked before the Sweepstakes Period begins, or after it ends, are invalid.
A. “Free Method of Entry”: mail your full name, home address, phone number, and a statement that you are entering the “Performance Remodeling Window of Opportunity Sweepstakes” to 14017 23 mile rd., Shelby Township MI 48315, which will award you one entry in the Sweepstakes. Performance Remodeling will contact you to request an appointment to provide a no-obligation free estimate after you sign up via the Free Method of Entry, but scheduling the free estimate appointment is not required to enter the Sweepstakes. You may also enter for free by scheduling a no-obligation, free estimate from Performance Remodeling and allowing a Performance Remodeling employee to present and discuss its services to you. You may only enter via a Free Method of Entry once during the Sweepstakes Period. The home address that you provide for your Free Method of Entry must be the address where any prize value will be used (whether in the form of a Refund or a Credit, as defined in Section 3 below).
B. “Contract Entry”: Contact Performance Remodeling to provide goods or services at your home address, and allow Performance Remodeling to inspect the work needed and provide an initial consultation with an offer to perform the work, then you will receive five entries in the sweepstakes. If you sign a contract for the work during the initial consultation and before the Performance Remodeling employee leaves, then you will receive ten entries in the Sweepstakes. If you sign a contract for the work any time after the initial consultation, then you will receive five entries. There is no limit on the number of Contract Entries that you may receive.
3. PRIZE: The value of the prize depends on the value of the goods and services that Performance Remodeling has provided to the winner under a single contract during the Sweepstakes Period, as shown on an invoice. If the winner purchased goods or services during the Sweepstakes Period, then the prize will be a refund of the contract amount paid on a single invoice of at least $10,000 and up to $100,000 (“Refund”). If the winner purchased goods or services on multiple contracts, as shown on multiple invoices, then the prize will be the highest paid invoice amount up to $100,000. If the winner did not make a purchase from Performance Remodeling during the Sweepstakes Period, or if the value of highest purchase during the Sweepstakes Period is less than $10,000 then the prize will be a refund of the amount that the winner paid, plus a credit for the amount between the purchase price and $10,000 (“Credit”). The Credit may be applied to a future Performance Remodeling invoice issued under a valid contract between Performance Remodeling and the winning owner of the Credit. The Credit will expire three years after it is awarded. If your invoice is less than $10,000, then you will receive a Refund of the invoice amount, and a Credit for the remaining value up to $10,000. No prize in this sweepstakes may be transferred to anyone other than those living in the household where the winner lives at the address matching the winner’s Sweepstakes entry. No substitution or transfer of prize permitted by winner. Performance Remodeling reserves the right to substitute a prize of equal or greater value. All prizes will be awarded. If a potential winner is disqualified for any reason, in Performance Remodeling’s sole discretion, then Performance Remodeling will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only three alternate drawings will be held, after which the prize will remain un-awarded. No Refund or Credit will be awarded to any individual whose invoice has been due and owing for more than 60 days, or who Performance Remodeling determines is unreasonably withholding payment.
4. ELIGIBILITY: The Sweepstakes is open to legal residents of the United States and the State of Michigan who own homes in Genesee, Livingston, Macomb, Oakland, Saginaw, St. Clair, or Wayne County, and who are 18 years of age or older as of the date that the individual enters the Sweepstakes. Employees, officers, directors, and owners of Performance Remodeling, and members of their immediate family or persons living in the same household are not eligible. The entrant’s home must be located in one of the counties listed above and in a suitable condition (determined in Performance Remodeling’s sole discretion) for performance of Performance Remodeling to perform its services and install products. The home must also be in compliance with local building laws, codes, and regulations. Any cost necessary to make the home suitable to use the prize must be paid by the winner.
5. DRAWING: A random drawing will be conducted within 30 days after the end of the Sweepstakes Period by Performance Remodeling to select the winner from among all eligible entries received. Odds of winning depend on the number of entries received. The potential winner will be notified phone (or if not immediately contacted, then Performance Remodeling may use alternative means of contact) and must sign and return any required Affidavit of Eligibility and Release within five business days of the date notice is sent or such other date set by Performance Remodeling. Failure to respond within the applicable time period will result in forfeiture of prize and Performance Remodeling shall have the option to award the prize to an alternate winner. The return of any prize notification or prize as undeliverable may result in disqualification and an alternate winner may be selected. All taxes resulting from acceptance of prize are the responsibility of winner. By entering this sweepstakes, entrant accepts and agrees to these Official Rules and the decisions of Performance Remodeling, which shall be final in all matters. Acceptance of a prize also constitutes permission to Performance Remodeling to use winner's name, image, likeness, and biographical information for marketing purposes without further compensation or right of approval, unless prohibited by law. All applicable federal and state laws apply.
6. LIMITATION OF LIABILITY: By entering this sweepstakes, entrants waive all right to, and hold Performance Remodeling harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys' fees) arising out of or in connection with participation in this sweepstakes or the acceptance, use, or misuse of any prize. Performance Remodeling will not be responsible for: late, incomplete, or incorrect entries; an entrant's failure to receive prize notices due to a failure of the entrant's technology, or a third party communication failure, or for entrants' provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed communications whether caused by the sender or by any of the equipment or programming associated with or used in this sweepstakes; by any human error which may occur in the processing of the entries in this sweepstakes; or any typographical, technological, or other error in the publishing of the offer, administration of the sweepstakes, or announcement of the prize. If, in Performance Remodeling’s opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the sweepstakes, or if technical difficulties (including viruses and bugs) compromise the integrity of the sweepstakes, Performance Remodeling reserves the right, in its sole discretion, to cancel or modify this sweepstakes in a manner deemed appropriate by Performance Remodeling. In the event of termination, the winner will be selected from among all eligible entries received as of date of termination. In the event a dispute arises as to the identity of a potentially winning entrant, entries will be declared made by the name on the online entry form, which may be subject to reasonable verification requests by Performance Remodeling. Any legal challenge to this promotion must be filed within 6 months of the end of the promotion. Such legal challenge will be waived if not filed within such period. Participation in the promotion constitutes a participant’s agreement to the 6 month limitation period.
7. CHOICE OF LAW AND FORUM: Entrant agrees that all matters arising out of or relating to this sweepstakes and these Official Rules are governed by, and construed in accordance with, the laws of Michigan, without giving effect to any of its conflict of laws provisions thereof. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to this sweepstakes and these Official Rules shall be brought exclusively in the applicable federal or state courts located in the Michigan counties of Macomb, Oakland, or Wayne.
8. WINNERS LIST: A list of the winner of the Sweepstakes will be made available upon request, for any request received by Performance Remodeling at one of the locations listed below within 6 months after the Promotion Period.
